GuideSofia Terms of Use

These Terms govern your use of the GuideSofia mobile application, website, and related services
(together, the “Service”). The Service is provided by OBSIDIANBLOOM
Rua Manuel Da Silva Leal 8 Esq., 1600-166 Lisboa, Portugal (“GuideSofia”, “we”, “us”, or “our”).

1. Acceptance of These Terms

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use
the Service. Our Privacy Policy explains how we
process personal data; it is provided for information and is not part of your acceptance of these Terms.

2. Age Requirement

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you
live, your parent or legal guardian must review and approve these Terms and supervise your use. Children
under 13 may not create an account or use the Service. A parent or guardian who permits a minor to use the
Service is responsible for that minor’s use, to the extent permitted by law.

3. The Service

GuideSofia provides travel information, audio content, recommendations, routes, and interactive or
AI-assisted features. Content may occasionally be incomplete, outdated, or inaccurate. Check important
details such as opening hours, prices, accessibility, routes, and safety information with the relevant
venue or authority. The Service is not an emergency service or a substitute for professional advice.

4. Your Account

You must provide accurate information, keep your login details secure, and tell us promptly if you believe
your account has been used without permission. You are responsible for activity on your account unless it
results from our failure to protect it or another matter for which the law makes us responsible.

5. Purchases and Subscriptions

Prices, subscription periods, trial terms, and renewal details are shown before purchase. Purchases made
through Apple App Store or Google Play are billed and managed by that store. You can manage or cancel a
subscription in your store account; cancellation normally takes effect at the end of the current billing
period. Refunds are handled under the store rules and applicable consumer law. Nothing in these Terms
limits any mandatory right of withdrawal, legal guarantee, refund, repair, price reduction, or termination.

6. Acceptable Use

You must not:

• use the Service unlawfully, fraudulently, or to harm another person;
• upload content that is illegal, abusive, deceptive, or infringes another person’s rights;
• interfere with the Service, its security, or another user’s access;
• attempt unauthorized access, automated extraction, reverse engineering, or circumvention of usage limits, except where the law expressly permits it; or
• use Service content commercially without our written permission.

7. Content You Submit

You retain ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free licence
to host, process, reproduce, and display that content only as needed to operate, secure, and improve the
Service and provide the features you request. The licence ends when the content is deleted, except for
limited backup retention, legal obligations, or content already shared with others through a feature you
chose to use. You must have the necessary rights to anything you submit.

8. GuideSofia Content

The Service and its text, audio, software, design, branding, and other content are owned by us or our
licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the
Service for lawful, non-commercial purposes under these Terms.

9. Third-Party Services

The Service may link to or rely on third-party maps, stores, venues, payment providers, or other services.
Their own terms and privacy practices apply to their services. We are not responsible for third-party
services, but this does not limit responsibility that cannot lawfully be excluded.

10. Availability and Changes

We may maintain, update, or change the Service. We will provide notice of material changes where required
by law. If a change materially and negatively affects a paid digital service, you may have a right to end
the contract under applicable consumer law.

11. Suspension and Termination

You may stop using the Service and request account deletion at any time. We may restrict or suspend access
where reasonably necessary for security, legal compliance, non-payment, or a serious or repeated breach of
these Terms. Where appropriate, we will give notice and an opportunity to correct the issue or contact us.
Any mandatory rights concerning your purchases, personal data, and submitted content continue to apply.

12. Responsibility

We provide the Service with the standard of care required by applicable law. We are responsible for losses
that are a foreseeable result of our breach of these Terms or our negligence. We are not responsible for
losses caused by events outside our reasonable control or for business losses arising from personal use of
the Service. Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused
by negligence, gross negligence, or any liability or consumer right that cannot legally be excluded.

13. Governing Law and Disputes

These Terms are governed by Portuguese law. If you are a consumer, you also keep the protection of any
mandatory consumer laws of the country where you live. Portuguese courts have jurisdiction, without
limiting any right you may have under applicable law to bring a claim in the courts where you live.

14. Changes to These Terms

We may update these Terms to reflect changes to the Service, law, or security needs. We will post the new
version and update the date above. Where a change materially affects your rights, we will give reasonable
advance notice where required and explain any choices available to you.

15. General

If any provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a
provision is not a waiver of it. These Terms do not give rights to anyone other than you and us, except
where applicable law provides otherwise.
